We must add a small service fee to help cover some of the increased costs of operating under COVID restrictions, including the development and hosting of this website to provide for for online advance ordering. We appreciate your understanding.

Customer acknowledges the 2019 novel Coronavirus outbreak requires New York State Farmers’ Markets to adopt special procedures and follow guidance (“Farmers Market Guidance”) from the New York State Department of Agriculture & Markets and most recently revised on May 22,2020 (available HERE), in order to open and to minimize the risk of spreading the infection.
Customer either placed an order (“Order”) at [URL for website] and paid for such Order online or at the weekly Sea Cliff Farmers Market (“Market”) held on Saturdays by the Sea Cliff Farmers Market, LLC., a Limited Liability Corporation in the State of New York (the “Corporation”). Customer has picked up or will pick up her/his Order at the Market by driving to [exact location], following instructions for curbside pick-up (if customer chooses that option) and allowing a representative of the Market to place her/his Order in Customer’s vehicle. Customer acknowledges that the Corporation’s role is limited to contracting with individual farms and vendors (collectively “Vendors”), providing an online ordering platform to Customer to select products offered by individual Vendors; collecting payment for such products and paying individual Vendors, as appropriate; communicating individual Customer Orders to participating Vendors and collecting prepackaged products from individual Vendors and putting a Customer’s aggregate Order in his/her vehicle. The Corporation assumes no liability or responsibility for any Vendor’s compliance with the Cleaning and Sanitary Protocols in the Farmers Market Guidance. The Corporation also assumes no liability for any personal injury or property damage, of any nature whatsoever, arising from the products provided by participating Vendors. Customer releases the Market and its officers, directors, employees, contractors, members, agents, shareholders, representatives, licensors, licensees and suppliers from all claims, demands, liabilities and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, now and in the future, arising out of or in any way connected with Orders except as expressly set forth in the first sentence of this paragraph.
Customer, listed below, by adding this Service Fee to your Cart at the bottom of this page, agrees and understands that her/his purchase is subject to giving the Sea Cliff Farmers Market the Release which is set out HERE.
Acknowledgment, General Release and Liability Waiver of Claims (the “Release”) voluntarily in order to place and pick up an Order. In consideration for such participation, Customer agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of New York and that if any portion of this Release is held invalid, it is agreed that the remainder will continue in full legal force and effect.
